GENERAL TERMS AND CONDITIONS OF SALE

These General Terms and Conditions of Sale govern the purchase of products marketed by Piccoli Pets di Giuseppe Piccoli through the websites www.piccolipets.it and www.piccolipets.com.

By placing an order, the Customer acknowledges having read and fully accepted these General Terms and Conditions of Sale.

2. Scope of Application

These General Terms and Conditions govern all purchases made through the Website by consumers and business customers, unless otherwise required by applicable law.

These Terms shall prevail over any conflicting terms proposed by the Customer unless expressly accepted in writing by Piccoli Pets.

Accessing the Website and placing an order imply full knowledge and unconditional acceptance of these General Terms and Conditions of Sale.

3. Definitions

For the purposes of these General Terms and Conditions:

Customer

Any natural or legal person purchasing one or more products through the Website.

Consumer

Any natural person acting for purposes outside their trade, business, craft or profession, as defined by the Italian Consumer Code (Legislative Decree No. 206/2005).

Business Customer

Any person or legal entity purchasing products in the course of its business, trade, craft or professional activity.

Personalized Products

Any product manufactured, modified or customized upon the Customer's request, including, by way of example, products featuring names, initials, embroidery, colors, materials, finishes or configurations different from the standard collection.

Order

The purchase request submitted by the Customer through the Website.

Contract

The sales agreement concluded between the Customer and Piccoli Pets in accordance with these General Terms and Conditions.

Business Days

Any day from Monday to Friday, excluding Italian public holidays and any company closure periods communicated on the Website.

Force Majeure

Any unforeseeable and unavoidable event beyond the reasonable control of Piccoli Pets that temporarily or permanently prevents the performance of its contractual obligations.

Website

The websites www.piccolipets.it and www.piccolipets.com.

4. Acceptance of the General Terms and Conditions

Before completing an Order, the Customer is required to carefully read these General Terms and Conditions of Sale.

Submitting an Order constitutes full acceptance of these Terms.

Piccoli Pets reserves the right to amend these General Terms and Conditions at any time.

Any amendments shall apply exclusively to Orders placed after their publication on the Website.

5. Products

Piccoli Pets designs, manufactures and markets accessories and products intended exclusively for companion animals, including, but not limited to:

  • collars;

  • leashes;

  • harnesses;

  • apparel;

  • pet carriers;

  • accessories;

  • personalized products;

  • seasonal collections;

  • limited editions.

Many of our products are handcrafted and may be manufactured only after an Order has been received.

For this reason, certain products may require production times different from those of items immediately available in stock.

6. Product Characteristics

Piccoli Pets pays particular attention to the quality of the materials and craftsmanship used in its products.

Technical specifications, materials, dimensions, finishes and colors are described in the relevant product pages.

Images, descriptions, graphics, videos and all other content published on the Website are provided for illustrative purposes only and may not perfectly represent the final product.

In particular, slight differences may occur due to:

  • handcrafted production;

  • different production batches of materials;

  • availability of raw materials;

  • the natural characteristics of the materials;

  • monitor or device display settings;

  • technical updates or product improvements that do not alter the essential characteristics of the product.

Such differences shall not constitute a lack of conformity.

The photographs published on the Website are intended to represent the products as accurately as possible. Any differences in color, brightness or proportions resulting from the display settings of electronic devices shall not be considered product defects.

Since handcrafted and personalized products are individually made, each item should be considered unique and may present slight variations from other products of the same model.

Provided that they do not affect the essential characteristics, quality, functionality or value of the product, such variations shall not constitute a lack of conformity and shall not entitle the Customer to cancel the Order, request a price reduction, replacement or refund.

Piccoli Pets reserves the right to replace materials, components, metal hardware, finishes, fabrics, crystals, accessories or other elements with products of equivalent or superior quality whenever this becomes necessary due to the unavailability of raw materials, discontinued production by suppliers, technical updates or manufacturing improvements.

7. Product Availability

All Orders are subject to the actual availability of products and raw materials.

The presence of a product on the Website does not guarantee its immediate availability.

Should one or more products become temporarily or permanently unavailable after an Order has been received, Piccoli Pets shall promptly inform the Customer and, where possible, offer one of the following solutions:

  • waiting for restocking;

  • an equivalent product;

  • modification of the Order;

  • full or partial refund of any amount already paid.

Piccoli Pets reserves the right to limit the quantities of certain products available for purchase, particularly in the case of limited editions, promotional products or made-to-order items.

The conclusion of the sales Contract is subject to the actual availability of the ordered product.

8. Prices

All prices published on the Website are expressed in Euro (€) and, unless otherwise specified, include the applicable Value Added Tax (VAT).

For Orders shipped outside the European Union, VAT may not apply where permitted by applicable legislation. Any customs duties, import taxes, local taxes or other charges imposed by the destination country shall be borne exclusively by the Customer.

Piccoli Pets reserves the right to change product prices at any time without prior notice.

Such changes shall not affect Orders already confirmed by the Seller.

9. Pricing and Publication Errors

Piccoli Pets takes the utmost care to ensure the accuracy of the information published on the Website.

Nevertheless, material, typographical, technical or IT-related errors may occasionally occur concerning, by way of example:

  • prices;

  • descriptions;

  • images;

  • technical specifications;

  • product availability;

  • promotional offers.

If a product is published with an obviously incorrect price or manifestly inaccurate information, Piccoli Pets reserves the right to correct the error and, where necessary, cancel the relevant Order even after the automatic Order confirmation has been sent, while providing a full refund of any amounts already paid by the Customer.

The automatic Order confirmation does not constitute final acceptance of the Customer's purchase proposal.

10. Conclusion of the Contract

The publication of products on the Website constitutes an invitation to treat and not a binding offer to the public pursuant to Article 1336 of the Italian Civil Code.

The Customer's Order constitutes a purchase proposal.

The sales Contract shall be deemed concluded only when Piccoli Pets sends the Customer an Order Acceptance Confirmation or dispatches the ordered products.

Piccoli Pets reserves the right not to accept an Order in the circumstances set out in these General Terms and Conditions.

11. Acceptance or Rejection of an Order

Piccoli Pets reserves the right to reject, suspend or cancel an Order, even after it has been received, in the following circumstances:

  • unavailability of the product or raw materials;

  • impossibility of manufacturing the requested product;

  • incomplete, inaccurate or unverifiable Customer information;

  • payment authorization failure;

  • suspected fraudulent use of the Website or payment methods;

  • abnormal Orders due to quantity or frequency;

  • previous unpaid balances owed by the Customer;

  • Force Majeure events;

  • obvious pricing or publication errors.

In such cases, the Customer shall be informed without undue delay and, where payment has already been made, shall receive a full refund of any amounts paid.

12. Payment Methods

The payment methods available are exclusively those displayed during the checkout process.

Depending on the destination country, Order value or other circumstances, certain payment methods may not be available.

Piccoli Pets reserves the right to modify, add or remove available payment methods at any time.

The payment shall be processed according to the procedures of the payment service selected by the Customer.

13. Payment Security

All transactions carried out through the Website are processed via secure payment platforms using internationally recognized encryption standards.

Piccoli Pets does not store nor have access to the Customer's complete payment card details.

Financial information is processed exclusively by authorized payment service providers.

14. Discount Codes and Promotions

Unless otherwise specified, each promotional code:

  • is personal and non-transferable;

  • may be used only once;

  • cannot be exchanged for cash;

  • cannot be combined with other promotions or discount codes unless expressly stated;

  • must be used before its stated expiry date.

Discount codes must be entered during the checkout process.

They cannot be applied after an Order has been completed.

Piccoli Pets reserves the right to cancel promotional codes obtained or used fraudulently or in violation of these General Terms and Conditions.

15. Personalized Products

Personalized Products are manufactured exclusively according to the specifications provided by the Customer.

It is the Customer's responsibility to carefully verify:

  • names;

  • initials;

  • wording;

  • colors;

  • materials;

  • measurements;

  • requested configurations.

Once production has begun, it will no longer be possible to modify or cancel an Order relating to Personalized Products.

Such products are also subject to the limitations on the right of withdrawal provided by applicable law and by the specific Returns & Refunds Policy.

16. Production Times

Many Piccoli Pets products are handcrafted after the Order has been received.

The production times indicated on the Website are therefore purely indicative and may vary depending on:

  • availability of raw materials;

  • complexity of the manufacturing process;

  • production workload;

  • peak seasonal periods;

  • public holidays;

  • events beyond the reasonable control of Piccoli Pets.

Production delays shall not automatically entitle the Customer to claim compensation, except where required by applicable law.

In any event, Piccoli Pets undertakes to promptly inform the Customer should significant delays occur.

17. Shipping

Piccoli Pets ships to Italy and to the countries available during the checkout process.

Shipping methods, delivery charges and any geographical limitations are available on the dedicated Shipping page and may be updated at any time.

Shipping costs are calculated automatically during checkout and clearly displayed before the Customer confirms the Order.

For Orders delivered outside the European Union, any customs duties, import taxes, local taxes or other charges imposed by the destination country shall be borne exclusively by the Customer.

18. Order Preparation

Orders are prepared after payment has been successfully verified, unless otherwise expressly specified.

Where an Order includes products with different production times, Piccoli Pets may, at its sole discretion:

  • dispatch the entire Order in a single shipment once all products are ready;

  • make partial shipments at no additional shipping cost to the Customer;

  • agree upon an alternative solution directly with the Customer.

19. Delivery Times

The delivery times indicated on the Website are purely indicative and shall be calculated from the date of shipment, not from the date the Order is placed.

Delivery times may vary due to, including but not limited to:

  • periods of high order volumes;

  • public holidays;

  • adverse weather conditions;

  • courier delays;

  • customs inspections;

  • Force Majeure events;

  • circumstances beyond the reasonable control of Piccoli Pets.

Piccoli Pets shall not be held liable for delays attributable to the courier or to circumstances beyond its direct control.

Should significant delivery delays occur, the Customer will be informed as soon as reasonably possible.

20. Delivery

Delivery shall be deemed completed when the products are made available to the Customer at the shipping address provided during the Order process.

It is the Customer's responsibility to carefully verify the accuracy of the shipping information before completing the purchase.

Piccoli Pets shall not be liable for delays, failed deliveries or additional costs resulting from:

  • incorrect or incomplete shipping addresses;

  • inaccurate recipient details;

  • absence of the recipient at the time of delivery;

  • failure to collect the parcel from the designated collection point;

  • unjustified refusal of delivery.

If a parcel is returned to Piccoli Pets for reasons attributable to the Customer, the Customer shall be responsible for all costs incurred for the return shipment and any subsequent re-shipment.

21. Inspection of Goods upon Delivery

Upon delivery, the Customer is encouraged to verify:

  • the integrity of the packaging;

  • the absence of visible damage;

  • that the number of parcels received corresponds to the shipping documentation.

If the packaging shows visible signs of damage, the Customer is advised to accept the delivery subject to specific reservation or refuse the shipment if the damage appears particularly serious.

Any anomalies should be reported to Piccoli Pets as soon as possible, together with photographs of both the packaging and the products.

22. Transfer of Risk

For purchases made by Consumers, the risk of loss of or damage to the products shall pass to the Customer only when the Customer, or a third party designated by the Customer other than the carrier, takes physical possession of the goods.

For purchases made by Business Customers, the risk shall pass upon delivery of the goods to the carrier, unless otherwise required by mandatory applicable law.

23. Legal Guarantee of Conformity

All products sold by Piccoli Pets are covered by the Legal Guarantee of Conformity provided under the Italian Consumer Code.

For Consumers, the legal guarantee is valid for 24 months from the date of delivery and covers only defects in conformity existing at the time of delivery.

The Customer must notify Piccoli Pets of any alleged defect within the time limits established by applicable law, providing all information necessary to assess the claim.

Where a lack of conformity is confirmed, Piccoli Pets shall provide, as required by law, repair, replacement, price reduction or refund, where applicable.

24. Exclusions from the Legal Guarantee

The Legal Guarantee does not cover damage resulting from:

  • normal wear and tear;

  • improper or unintended use of the product;

  • inadequate maintenance;

  • negligent use;

  • modifications or repairs carried out by unauthorized persons;

  • damage caused by the animal, including, by way of example, bites, scratches, pulling or any use incompatible with the intended characteristics of the product;

  • contact with chemicals, solvents, aggressive detergents or other external agents;

  • prolonged exposure to salt water, chlorine, mud, sand or other substances capable of altering the materials or finishes;

  • natural deterioration of materials, stitching, decorative components, crystals, plated finishes or any other parts subject to normal wear.

The natural characteristics of handcrafted production, as described in the Returns & Refunds Policy, shall not be considered defects in conformity.

25. Customer Support

If the Customer experiences any issue relating to a purchased product, they are invited to contact Customer Service promptly at info@piccolipets.it, providing:

  • Order number;

  • detailed description of the issue;

  • photographs of the product;

  • any supporting documentation useful for evaluating the request.

Piccoli Pets is committed to handling every request with the utmost care and within a reasonable timeframe.

26. Product Use

All Piccoli Pets products are designed and manufactured exclusively as accessories intended for companion animals.

The Customer shall use each product only for its intended purpose, in accordance with any instructions provided and in compliance with ordinary standards of care.

Products must not be used for purposes other than those for which they have been designed.

27. Animal Safety and Owner Responsibility

The safety of the animal also depends on the correct use of the product and on the continuous supervision of its owner.

The Customer is responsible for regularly inspecting collars, leashes, harnesses, accessories and all other purchased products, and must immediately discontinue their use if signs of wear, deterioration or damage are detected.

No product should be considered indestructible or immune to wear.

Piccoli Pets shall not be held liable for damage resulting from:

  • improper use of the product;

  • use contrary to its intended purpose;

  • inadequate maintenance;

  • failure to inspect the product for wear;

  • unpredictable behaviour of the animal;

  • use of the product on animals whose size, strength or physical characteristics are incompatible with the product;

  • use of the product without appropriate owner supervision.

28. Materials, Decorative Components and Finishes

Many Piccoli Pets products are embellished with decorative elements including, but not limited to:

  • crystals;

  • pearls;

  • charms;

  • bows;

  • metal embellishments;

  • trimmings;

  • ornamental components.

These decorative elements serve primarily an aesthetic purpose and, although applied in accordance with high quality standards, are naturally subject to normal wear resulting from regular use of the product.

Piccoli Pets recommends avoiding:

  • impacts;

  • friction against abrasive surfaces;

  • bites or pulling caused by the animal;

  • contact with salt water, chlorine, sand, mud or chemical substances;

  • use together with accessories featuring incompatible metal finishes.

The loss or deterioration of decorative elements resulting from normal wear or improper use shall not be considered a lack of conformity.

29. Metal Plating and Surface Finishes

The metal components of our products are treated with high-quality electroplated finishes.

However, the durability of such finishes may be affected by several factors, including:

  • daily use;

  • friction;

  • contact with other metals;

  • weather conditions;

  • humidity;

  • chemicals;

  • perspiration;

  • salt water;

  • chlorine.

Piccoli Pets does not guarantee that electroplated finishes will remain unaltered when products are used under conditions different from their intended normal use.

30. Intellectual Property

All content available on www.piccolipets.it and www.piccolipets.com, including but not limited to:

  • trademarks;

  • logos;

  • photographs;

  • images;

  • videos;

  • catalogues;

  • product descriptions;

  • graphics;

  • designs;

  • product models;

  • collections;

  • artwork;

  • social media content;

  • website layout;

is the exclusive property of Piccoli Pets or is used under valid authorization.

Any reproduction, distribution, modification, publication, commercial use or exploitation, whether in whole or in part, is strictly prohibited without the prior written authorization of the rights holder.

31. Limitation of Liability

Except where liability cannot be excluded or limited under applicable law, Piccoli Pets shall not be liable for:

  • indirect or consequential damages;

  • loss of profits;

  • loss of business opportunities;

  • damages arising from improper use of the products;

  • damages resulting from incorrect maintenance;

  • damages caused by the behaviour of the animal;

  • interruptions to the Website;

  • internet or network failures;

  • delays attributable to shipping carriers;

  • events beyond the Seller's reasonable control.

Nothing in these Terms shall exclude or limit any liability that cannot legally be excluded under applicable law.

32. Force Majeure

Piccoli Pets shall not be liable for any delay or failure to perform its contractual obligations where such delay or failure results from events beyond its reasonable control.

Such events include, but are not limited to:

  • natural disasters;

  • fires;

  • floods;

  • earthquakes;

  • pandemics;

  • wars;

  • strikes;

  • transport disruptions;

  • shortages of raw materials;

  • actions by public authorities;

  • customs restrictions;

  • interruptions to telecommunications, IT systems or energy supply.

In such circumstances, Piccoli Pets shall be entitled to suspend or extend the performance of its contractual obligations for the duration of the Force Majeure event.

33. Privacy

Personal data are processed in accordance with Regulation (EU) 2016/679 (GDPR), the applicable Italian data protection legislation and any subsequent amendments.

For further information, Customers are invited to consult the Privacy Policy published on the Website.

34. Amendments to the General Terms and Conditions

Piccoli Pets reserves the right to amend these General Terms and Conditions of Sale at any time.

Any amendments shall become effective from the date of publication on the Website and shall apply exclusively to Orders placed thereafter.

35. Governing Law and Jurisdiction

These General Terms and Conditions shall be governed by and construed in accordance with the laws of Italy.

For disputes involving Consumers, jurisdiction shall lie with the court of the Consumer's place of residence or domicile in Italy, where required by applicable law.

For disputes involving Business Customers, the Court of Bologna (Italy) shall have exclusive jurisdiction, unless otherwise required by mandatory applicable law.
